A Monaco judge recently granted full custody of the children to Kelly Rutherford's ex-husband

Just days after news broke Kelly Rutherfordcould only see her children in Europe after her ex-husband won full custody, it appears the actress might already be back to visit them.

Since Thursday, Rutherford, 47, has posted several pictures on Instagram that seem to indicate she is currently in Italy, including one of a package of Golia Blanca, an Italian mint, and another of a Vespa parked in the streets of The Golden Square in Milan.

The former Gossip Girl actress could be in Europe to visit her children Hermes, 9, and Helena, 6, for the winter break.

The children have lived with their father in both Monaco and France since 2012, and a Monaco judge recently upheld full custody of the children for Rutherford’s ex-husband Daniel Giersch, banning Rutherford from bringing them to the U.S. However, per the court’s custody agreement, she is allowed visitation during the second-half of their winter break from school this year.

This week, Rutherford was dealt another blow in her attempt to win back custody after a U.S. appeals court refused to hear her last-ditch appeal of a New York judge’s ruling that gave Giersch, 47, custody of the kids last summer.

According to court documents, the Monaco order also stipulates that Rutherford and Giersch, a German businessman, must make “any important decisions concerning health, schooling, religious education and any change of residence” together.
