Billy Bush will not go quietly from his Today show gig. The host is readying for a legal battle with NBC in order to keep his job.

Bush, 44, recently hired high-profile defense attorney Marshall Grossman — news originally reported by The Hollywood Reporter and confirmed by — as well as power entertainment lawyer Bob Lange.

The TV host has been under fire since the leak of a tape last week in which he made lewd and graphic comments about women while filming a segment with Donald Trump for Access Hollywood in 2005.

A source recently told PEOPLE Bush was negotiating his exit from Today after he was suspended indefinitely from the NBC talk show pending review on Sunday.

“It could be resolved immediately or it could take quite some time,” says the insider. “They’re looking at all aspects of it.”

The news of Bush’s “lawyering up” however, indicates that he will not go down without some sort of legal fight.

“If Billy had been passive or responded ‘Shut the f— up’ to Trump, Billy would have been out of a job the next day,” Bush’s new lawyer, Marshall Grossman, told The Hollywood Reporter

Grossman had no comment; Lange did not respond to PEOPLE’s request for further comment.
