The star's estranged husband, Lamar Sally, has said he wants to raise the baby

Sherri Shepherd‘s surrogate has reportedly given birth – though it remains unclear if the former View panelist will have a role in the baby’s life.

The surrogate welcomed a boy Tuesday in Pennsylvania, according to TMZ. When contacted by PEOPLE, Shepherd declined to comment about the birth.

Her estranged husband Lamar Sally has asked for custody of the child in court documents, but last week he said the separated couple has not yet reached an agreement.

“It’s still unclear what’s going on,” he told PEOPLE.

Shepherd, 47, and Sally, 43, shocked fans when they split in May after almost three years of marriage. The breakup instigated an ugly legal battle that coincided with her first husband Jeff Tarpley’s petition for custody of their son.

Tarpley accused Shepherd of neglecting 9-year-old Jeffrey for her career, an attack that spurred the actress to defend working mothers on her show. A judge denied Tarpley’s request in July.

Shepherd, who will star as the wicked stepmother in Broadway’s Cinderella starting Sept. 9, alluded to the troubles to come after that courtroom victory.

“Keep the prayers coming,” she Tweeted. “Still got more battles.”
