Amber Heard is concerned about her dog, Pistol.

Heard, 30, asked for sole possession of the dog when filing a domestic violence restraining order against Johnny Depp on Monday.

She asked that Depp stay at least 100 yards away from the pet, according to court documents obtained by PEOPLE.

However, a judge denied the request stating that there was “insufficient showing of need to protect pet dog.” The judge issued a temporary restraining order requiring Depp to stay 100 yards from Heard, and granting her exclusive use of the couple’s downtown LA apartment

While Depp and Heard had two Yorkshire Terriers living with them, Pistol was reportedly given to the actress long before she got married.

“Her ex-girlfriend Tasya [van Ree] gave her the dog,” a source told Entertainment Tonight.

Boo, the second dog, is believed to belong to Depp.

The two pooches made headlines when Heard was accused of smuggling them into Australia while Depp was filming Pirates of the Caribbean. The actress was given a one-month good behavior bond last month after the actress pleaded guilty to providing a false immigration document when entering Australia last May with the dogs.
