In a document filed Sept. 1, the L.A. Superior Court court clerk warned the couple that if they don’t take any action soon on their divorce filing, it could be dismissed.
Despite rumors of a reconciliation, a source close to the couple tells PEOPLE that Berry and Martinez are not back together.
“Nothing is happening, no real change,” says the source. “She definitely has no interest in getting back with Olivier unless his temper and controlling nature change. And there’s no indication that either will, so it seems that they will remain separate.”
Meanwhile, a Martinez source tells PEOPLE that the actor didn’t want to split in the first place.
“Olivier never wanted the divorce,” says the source. “It’s not surprising that they haven’t moved forward.”
But while Martinez may be hoping for a reconciliation, the source close to the couple says they are better off apart.
“Neither is rushing to finalize a divorce, as it’s not, nor has it ever been, about another person,” says the source. “It’s about who they are together and who they are apart. And they seem much happier apart.”
For now, Berry and Martinez, both 50, are moving forward by focusing on what’s best for their son Maceo, 3, and Nahla, 8, Berry’s daughter with ex-boyfriend Gabriel Aubry.
“They are devoted to their children and co-parent quite amicably,” says the source close to the couple. “That is their new normal.”
