A Utah teacher is facing more felony charges after one of her students revealed the two had sex – after her arrest on rape charges.
Brianne Altice stands accused of having sex with several of her students at Davis High School, which lies just outside of Salt Lake City.
She was initially arrested in October 2013 after a then 16-year-old boy told police they’d had multiple sexual encounters, according to The Salt Lake Tribune.
A second boy came forward last year. He described Altice as a “teacher with benefits” and said that they had a relationship between April and June of 2013 that eventually led to sex at the boy’s Farmington home, the Tribune reports.
Altice, 35, was later accused of raping a third boy, according to Reuters. Altogether, she faced 10 felony charges, including five counts of first-degree felony rape, two counts of first-degree felony forcible sodomy and three counts of second-degree felony forcible sexual abuse, according to the Tribune.
But on Wednesday, she was arrested again after one of the three boys from the first case accused her of having sex with him after she’d already been arrested for raping him and the two others.
She also allegedly sent him “a text message with a photograph of her bare breasts,” according to court documents obtained by the Deseret News.
Altice has been charged with an additional three counts of illegal sexual activity and one count of dealing in harmful material to a minor, Reuters reports.
Prosecutors have filed it as a separate case because the activity allegedly happened after Altice was no longer a teacher, the Deseret News reports. She was fired from her job in February.
For her part, Altice has denied the sexual encounters. “It is her defense that they did not happen at all,” her attorney, Edward Brass, wrote in a motion obtained by the Tribune. “That she never engaged in any inappropriate contact with either of her students …”
But that motion was filed before the additional charges came to light.
Meanwhile, prosecutors say that Altice admitted to having sex with the 16-year-old boy on two occasions, though Brass has said that confession was made under duress, according to the Tribune.
If convicted, Altice faces up to life in prison.
