PEOPLE has learned that a grand jury in Georgia is being convened regarding Gordon. (“The case remains open and under investigation,” the district attorney tells PEOPLE.)
A source tells PEOPLE that the grand jury would decide, possibly this week, whether or not Gordon would face charges in relation to his girlfriend’s death.
News of the charges come in the midst of continuing controversy – including the civil wrongful death lawsuit Gordon currently faces – surrounding Brown’s death on July 26.
PEOPLE reported earlier this month that the 24-year-old is accused of giving Brown, 22, a “toxic cocktail” that rendered her unconscious before he allegedly placed her facedown in a tub of cold water.
At the time, Gordon’s legal team released a statement calling the lawsuit “slanderous” and “shameful.”
“The recent lawsuit against nick is slanderous and meritless,” his legal team said. “Nick has been heartbroken and destroyed over the loss of his love, and it’s shameful that such baseless allegations have been presented publicly.
“Nick has engaged civil counsel and intends to defend the lawsuit vigorously and expose it for what it is: a fictitious assault against the person who loved Krissy most.”
