Mindy McCready potentially faces more legal drama after announcing she probably won’t return her 5-year-old son to Florida despite a court’s order.

“No matter what happens, I’m going to protect my kid,” the pregnant songstress told the Associated Press in a tear-filled interview on Wednesday. “If I have to go to jail, so be it.”

McCready also reveals that she and her son Zander are in Nashville. After taking the boy from her father, who has custody with her mother, in Florida on Tuesday, a judge ordered the child returned by Thursday evening.

McCready, 36, who is legally allowed visitations with her child, denies that she kidnapped him, saying she was working with lawyers to get the matter resolved.

McCready tells AP that being nearly seven months pregnant with twins prevents her returning to Florida. (Her rep has told PEOPLE she’s six months pregnant.)

In the AP interview, she accused her mother, Gayle Inge, of abusing Zander. Inge calls the allegations “absolutely not true.”
