Troubled pop star Justin Bieber claimed his wobbly sobriety test following his Jan. 23 arrest in Miami Beach was due to a hairline fracture in his right foot.

According to a police document released Tuesday by the Miami-Dade State Attorney’s office and obtained by PEOPLE, Bieber, 20, told police officers that he had injured his foot while skateboarding three months prior and also hurt his right knee earlier in January.

The officer noted that Bieber, who’d been arrested for DUI and drag racing, seemed to sway and experience leg tremors during one of the psychophysical tests, and also made a face that showed he was in pain.

“He winced when he was performing on his right foot,” the report stated, adding that he raised both arms for balance and swayed heavily, appearing to have “great difficulty.”

Bieber said he never underwent a foot X-ray because “it wasn’t what he would consider an injury.” The alleged injury was not mentioned or noticed after the tests.

The police summary also said Bieber claimed he had a cold coming on.

The report further described the pop star as “agitated and condescending” and using swear words when he was brought into the police station, questioning why he was brought in at all.

“He got upset and said, ‘I’m 19 years old, I’m just having a good time. What were you doing when you were 19?’ ”

The police officer retorted that he was not driving around in a Lamborghini at that age.

According to the report Bieber responded by saying, “Yeah, well, I bet you didn’t have millions of dollars in your bank account either.”

Bieber was charged with driving under the influence, resisting arrest and driving without a valid driver’s license. He has pleaded not guilty to all charges and is awaiting trial now scheduled for May 5.
