An Ohio dad was indicted on Tuesday after his daughter’s body was found rotting in her crib last week.

Eric Warfel, 34, faces felony charges of abusing a corpse and tampering with evidence for keeping 21-month-old Ember Warfel’s body in the crib for over a month after she died, the Associated Press reports.

He was arrested on July 29 after a cable company employee found the toddler’s decomposing body.

However, Warfel could face more serious charges in the future, pending an investigation into the cause and manner of the tot’s death. The medical examiner has not yet ruled on either.

It’s not the first time an infant in Warfel’s care has died. Five-month-old Erin Delynn Warfel died in March 2013, Cuyahoga County Medical Examiner’s office records show. The baby died while Warfel lived in Cleveland, and the cause of death was ruled as “sudden unexplained infant death,” according to the AP.

Warfel had sole custody of Ember, the AP reports. Her mother, Malinali Galdamez, was notified by police of her daughter’s death and the discovery of her body.
