The American Pie actor is formally charged for his second drunk driving arrest

Chris Klein is facing a mandatory sentence of four days in jail if he’s convicted of his second DUI offense, the L.A. City Attorney’s office announced Monday.

Klein, 31, has been formally charged for driving under the influence with a prior conviction and driving with a .08 blood alcohol level or higher. He was previously convicted in 2005.

The American Pie actor was arrested on June 16 after he was spotted weaving between traffic lanes around 3 a.m. The actor’s blood-alcohol level was nearly three times the legal limit, police said.

For now, Klein – who checked into a rehab facility last week – may also be subject to a breath check for alcohol every time he wants to start his car due to a new California law for repeat DUI offenders.

“If he wants his license back, Klein will have to get an interlock device installed in his car and blow into it every time he wants to start the engine,” California Highway Patrol spokesman Leland Tang confirmed.

An arraignment has been set for July 9.
