The comedian faces four misdemeanors following his arrest last month

Andy Dick was formally charged with assault and drug possession following an arrest in July, prosecutors in Riverside County, Calif., said Monday.

The comedian, 42, faces a total of four misdemeanors: assault, possession of marijuana and Xanax (without a prescription) and public intoxication. Dick’s arraignment is set for Wednesday.

He was not charged with sexual battery, because “after reviewing the evidence, we determined misdemeanor assault was the appropriate charge,” said Riverside DA spokesman Ryan Hightower.

On July 16, Dick was arrested outside the Buffalo Wild Wings Grill & Bar in Murrieta, Calif., after he allegedly “walked up to the 17-year-old female victim, grabbed her tank top and bra and pulled them down and exposed her breasts,” said a police statement at the time of the arrest.

The former NewsRadio star was “extremely intoxicated,” and marijuana and Xanax were found in his pockets, police also said.

Dick has had previous brushes with the law. Last year, he was cited in Columbus, Ohio, for urinating on a sidewalk. In 2004, he was arrested for pot possession, though the case was later dropped.

In 1999, Dick was charged with DUI, drug possession and hit-and-run driving after crashing into a telephone pole in L.A. He received three years’ probation and was ordered into drug treatment.

Calls to his rep on Monday were not returned.
