Setting up a potential turf battle, the superstar answers Katie Holmes's New York filings

A battle line has been drawn in the Tom CruiseKatie Holmes divorce.

A week after Holmes, 33, went to court in New York on June 28, Cruise, 50, answered Thursday with his own divorce petition a continent away in Los Angeles, setting the stage for a possible turf battle.

The superstar cited the usual “irreconcilable differences” for the end of their five-year marriage and tk on custody and support, according to the papers filed in Superior Court.

Holmes had reportedly requested sole legal custody, meaning this could also tk fight over custody.

After a whirlwind romance, Cruise and Holmes welcomed Suri in 2006 and later that year wed in an Italian castle.

Holmes and her 6-year-old daughter are now living in a new apartment in New York after leaving the apartment elsewhere in the city they had shared with Cruise. The actor makes his home base in Los Angeles.

L.A. family law attorney Scott Weston says that the litigation over which court will handle the divorce “could be a huge battle.”

“A lot of evidence would have to be heard about residential rules, where the child has been primarily sleeping, the child’s education, etc.,” says Weston, who’s not involved in the case. “There could be all kinds of motions filed and hearings held. This case could feasibly be heard simultaneously on both coasts.”

This was Holmes’s first marriage and the third for Cruise, who previously was married to the actresses Nicole Kidman, with whom he has two teenage children, and Mimi Rogers.
