John Draper Witherspoon, 29, the brother of “Sweet Home Alabama” and “Legally Blonde” star Reese Witherspoon, was arrested in Nashville, Tenn., Saturday facing charges of aggravated burglary and sexual battery, reports.

Witherspoon was brought to night court at around 1:40 a.m. Saturday morning. The unnamed accuser, a young woman, says she had fallen asleep on her living room sofa with her front door unlocked when Witherspoon, her new neighbor, entered her house.

“I woke up with him kissing my face and my neck, and I was wearing overalls at the time, and he unlatched one side of the overalls, had his hand down my underwear and was trying to get my pants off when I woke up,” the alleged victim said, according to Nashville’sWKRN-TV News.

In court, Witherspoon appeared to show little concern for the charges against him, the station reports. His bond was set at $24,000.

In addition to the burglary and sexual assault charges, Witherspoon was also arrested last week after authorities discovered that he was wanted on a prior charge of reckless driving under the influence of alcohol, according to the New York Post.

Contacted by the newspaper, the publicist for Reese Witherspoon, 26, when asked about brother John, reportedly issued a terse “no comment.”
