Jeremy Renner's Wife Asking for Primary Custody of Their Daughter in Divorce

Renner's estranged wife, Sonni Pacheco, is claiming his home is an unsafe environment for their daughter Ava

Sonni Pacheco is requesting primary custody, child support and lawyers fees from her estranged husband, Jeremy Renner.

The two were married for less than a year when Pacheco, 26, filed papers to end their marriage in early December 2014.

According to court documents obtained by PEOPLE, Pacheco is asking for primary physical custody but joint legal custody of their 22-month-old daughter, Ava Berlin, claiming that Renner’s house is unsafe.

The documents cite the household hazards as an unfenced pool area and koi pond, as well as a gun and weapon collection, and demands that Renner baby-proof his L.A. residence.

“I have been the parent that cares for Ava on a daily basis,” Pacheco claims in the papers. “[Renner] rarely spent one-on-one time with Ava and when he did it’s my recollection it was as a result of my insistence that he do so.”

Pacheco also asks for child support, stating that Renner, 44, earned $3.4 million in 2014 and has $13 million in assets, while she is currently unemployed with no income. In addition, she’s requesting $75,000 in attorneys’ fees and $25,000 for additional legal expenses.

The actress and model claims that Renner is withholding her passport and did so to prevent her from flying home to see her family during the recent holidays.

“I am seeking an order from the Court requiring [Renner] to return my social security card and birth certificate, which were maintained in the safe at [his] residence, and my passport and drivers license which were in my wallet,” the papers state.

Pacheco has cited irreconcilable differences as the reason for the split, and says their prenuptial agreement should be voided because it’s based on “fraud.”

A rep for Renner had no comment.
