The hockey player has filed a response to Duff's divorce petition

As Hilary Duff and Mike Comrie’s divorce moves forward, it seems the famously friendly exes have different views on parenting their child.

The retired ice hockey player filed his response to Duff’s divorce petition last week, seeking joint legal and physical custody of 3-year-old son Luca.

Comrie, 34, also asked that their assets and property be divided based on the terms of their prenuptial agreement.

The singer and Younger actress filed for divorce in February, requesting primary custody of Luca with visitation rights for Comrie. This was about a year after the stars announced the breakup – but they remained close for Luca’s sake, even going on a family vacation shorty after their split.

“We are a unit and we’re going to be a unit for the rest of our lives,” Duff, 27, told PEOPLE earlier this month. “We realized [as a couple] we weren’t where we used to be. But I feel so lucky this happened when Luca was young because this is his normal now.”

Duff and Comrie wed in August 2010 after about three years of dating. This was the first marriage for both.
