'30 Rock'' s Tracy Morgan Charged with DWI

The actor is pulled over for allegedly driving drunk in New York City

Actor Tracy Morgan was arrested Tuesday in New York City on drunken driving charges.

Morgan, 38, was pulled over early Tuesday morning after allegedly “weaving back and forth, into the right and left lanes” while driving on the Henry Hudson Parkway, Edison Alban, a spokesman for the Manhattan District Attorney’s office tells PEOPLE.

He was booked at New York’s 28th precinct and brought up on two misdemeanor counts of operating a motor vehicle while intoxicated – one because he failed a Breathlyzer test and another because he was observed swerving – and one count of operating a motor vehicle while impaired, Alban said.

He’s due to appear in Manhattan’s state Supreme Court on Jan. 4 for a possible deposition.

The rep for 30 Rock had no comment.

The former Saturday Night Live player is already on probation stemming from a Dec. 2 DUI arrest in Los Angeles last year, the Associated Press reports.

In February 2006, he pleaded no contest to that charge and was sentenced to three years’ probation. He was also ordered to attend alcohol-awareness classes.

Morgan was an SNL cast member from 1996 until 2003. He went on to star in his own short-lived NBC sitcom, The Tracy Morgan Show. He currently plays Tracy Jordan, a character he described to PEOPLE recently as “a pretty lunatic guy” in the NBC comedy 30 Rock.
