Tirado, who claimed he was only trying to restrain the child during a tantrum, faces 5 to 15 years in prison when he is sentenced Dec. 14. Carey’s father, Michael, tells PEOPLE, “My wife, Lisa, and I … hope that this case will set a precedent to investigate restraint deaths much more thoroughly nationwide.”
