EOS Lip Balm Being Sued by Consumers Claiming Harsh Side Effects Like Rashes and Blisters (UPDATE)

Update: The class action lawsuit against EOS has been resolved.

Mark Geragos, the lawyer who brought the class action lawsuit against the lip balm brand, released a statement claiming EOS will update its packaging to provide consumers with information regarding previous consumer reactions.

“I am very pleased that we have been able to so quickly and amicably resolve the matter with EOS lip balm products. This is a testament to EOS being responsive to the concerns of their consumers,” he said. “EOS has demonstrated through data that their lip balms are hypoallergenic, and has provided a mechanism for individual instances to be resolved. EOS makes great products and the company is doing the right thing by adding more information about their lip balm products on packaging so that buyers can make informed choices. We will be applying to the courts to close this case.”

EOS also commented on the resolution of the lawsuit with the following statement:

“We are pleased to announce that the class action lawsuit brought against EOS earlier this month has been resolved. Our products are safe — and this settlement confirms that. Our lip balms are hypoallergenic, dermatologist tested, made with the highest quality ingredients, meet or exceed all safety and quality standards set by our industry and are validated by rigorous safety testing conducted by independent labs. We love our customers and their enjoyment of our products is our top priority. We thank them for their continued support.”

Just one month after Chaz Dean’s WEN Hair Care line made headlines over alleged hair loss claims by consumers, another beauty brand is being called under fire: EOS.

The celebrity-loved lip balm brand (Kim Kardashian West, Hilary Duff and Miley Cyrus are all fans) is taking major heat after a class action lawsuit was filed, claiming the drugstore product brought on negative side effects, such as dryness, redness, blistering and rashes.

The lawsuit, which was filed by consumer Rachael Cronin, states that after applying EOS lip balm, within hours she began noticing a change her lips. They began cracking, blistering and bleeding “from the cracks,” and these side effects lasted for 10 days, she said.

The full description, as stated in the lawsuit, reads:

“A substantial number of consumers, upon information and belief in the tens of thousands, and potentially in excess of hundreds of thousands, who have purchased and used the product — spanning all gender, ages, and race — have experienced devastating adverse reactions to the product, consisting of mild to severe rashes, dryness, bleeding, blistering, cracking, and loss of pigmentation, lasting from a few days, to a few months, and some consumers with long-lasting and perhaps permanent symptoms.

EOS is, and has been, on notice of the serious adverse side-effects caused by the use of its product. Consumer complaints have flooded the EOS Facebook page and their email. Consumers, including the Plantiff in this action have written to EOS to share their complaints and adverse health problems arising from the use of the production.”

The lawsuit also states that after 10 days of experiencing the above-mentioned side effects and reapplying the product to soothe the issue, Cronin decided to share photos of her experience on Facebook. Once she took her story public, hundreds of other consumers, who experienced similar results chimed in on the issue, which caused her to bring the issue to public via a class action lawsuit.

When asked for comment on the lawsuit, EOS responded to PeopleStyle with the following:

“We firmly believe this lawsuit is without merit. Our products are made with the highest quality ingredients and meet or exceed all safety and quality standards set out by our industry and validated by rigorous testing conducted by an independent lab,” Nancy Chan, marketing director of EOS, tells PeopleStyle. “The health and well-being of our customers is our top priority and millions of satisfied customers use our products every day, many of whom take the time to share their experiences with us.”
