The Total Recall director filed for divorce citing irreconcilable differences. His court documents state that he and Beckinsale have both waived any right to spousal support, and according to TMZ, which first reported the news, this decision suggests there is a prenup.
The former couple met in 2003 while working on the first Underworld film together, which Wiseman directed, and they later tied the knot in 2004. The two do not have any children together. Beckinsale has a 16-year-old daughter, Lily, with former partner Michael Sheen.
Last November, a source close to the couple told PEOPLE that Beckinsale and Wiseman had been separated for several months.
“They are still friendly and spend time together in L.A. when Kate is there,” said the source, adding that “there has been no drama.”
“It’s just not Kate’s style,” the source continued. “They have both had complicated schedules and have grown apart.”
At the time, Wiseman was spotted heading into the Hollywood hot spot The Nice Guy with CJ Franco, then 24, and the Live Free or Die Hard director was noticeably not wearing his wedding ring.
Both Beckinsale and Wiseman have been seen without their wedding bands in the past. “[Wiseman’s] primary concern in all of this is Lily. He loves his stepdaughter and is there for her,” a second source told PEOPLE last year.
